Santos Escalera-Salgado (“Escalera”) and Olga Pagan-Torres (“Pagan”), individually and on behalf of their minor children, J.E.P. and D.E.P., brought this action against the United States of America under the Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 2671-2680, alleging that federal agents shot Escalera without provocation while executing a search warrant at his apartment residence.
