This is an appeal from a judgment rendered against the defendant in the district court of Ward county upon a verdict of the jury and from an order denying a motion for judgment not withstanding the verdict or for a new trial. The plaintiff was injured in an accident which occurred on state highway No. 3 between the towns of ITurdsfield and Harvey about four o’clock p. m. September 3, 1934.
