HEMPHILL, District Judge.

Defendant’s motion to dismiss projects this case before this court for a decision, the fourth in a series of litigations arising out of tax assessments against plaintiff and related taxpayers. Initially, Chief Judge Martin ruled on the efforts of the taxpayers to forestall collection. Cooper Agency Inc. v. McLeod (D.C. S.C.1964), 235 F.Supp. 276; affirmed per curiam 348 F.2d 919.
