Reversing.

This is an appeal from a judgment of the Campbell circuit court in a suit of the appellee, Fred H. J. Lampe, as plaintiff, against the appellant, Joseph 0. Hermann, as defendant, and by which the answer of appellant in that action as amended was held insufficient on demurrer, and did not present a valid defense to the cause of action set out in the petition, and that the appellant was a usurper of the office of commissioner of the city of Newport and had been such since the 11th day of November, 1916, and that the appellee was the duly elected to and…
