The last will and testament of Dr. Prank K. Plolman; deceased, was proved in common form in the Probate Court of Sumter County. Thereafter Mrs. Somers D. Holman, the widow of the testator, filed the prescribed notice, requiring that the instrument be proved in solemn form of law. Thereupon, the Sumter Trust Company, qualified executor and trustee, under the will, instituted the present action. The trial was first had before Hon. Thomas E.
