THOMAS, District Judge.
Two libels, one against the ship and one against the cargo, have been filed and tried together, and will be considered and determined together.
The record shows ■ that the British schooner J. Duffy cleared from Havana for St. Pierre Miquelon, on December 2, 1924, carrying a cargo of liquor. On December 20, 1924, at about 1:24 a. m., she was arrested in Long Island Sound by the Coast Guard Destroyer Downes, in command of F. W. Brown.
