The appellee, whom we shall call the plaintiff, recovered a judgment for $5,000 for personal injuries, and from that judgment the defendant has appealed. This case had been tried once before, and a new trial.granted in the trial court. On that trial the jury returned a verdict for $10,009, in favor of the plaintiff, and by a cross-appeal plaintiff is seeking* to have that verdict -substituted for the $5,000 verdict.
