There are two main issues in this appeal from a judgment in which a surety was held to have been released from all obligations under a performance bond and held not liable under a payment bond. The first issue is whether the trial court erred in holding that a modification of the principal contract released Peerless Insurance Company (Peerless) as surety of that contract under Peerless’ performance bond.
