Appellant R.R. Yalamanchili appeals the trial court’s order granting summary judgment on his nuisance and trespass claims against appellee Chayn Mousa. We affirm in part and reverse and remand in part.

BACKGROUND

Mousa owns a shopping center adjacent to a residential neighborhood, and Yala-manchili owns property in that neighborhood. In the spring of 2002, Yalamanchili discovered that his yard was retaining moisture, causing his plants and trees to die. Trees continued to die over the next several years.
