I. Introduction

This Memorandum addresses the Renewed Motion of Ecogen Inc., Dr. Leigh English, and Dr. Bruce Carlton to Quash Subpoenas and for a Protective Order.1 Mycogen Plant Science, Inc., and Agrigenetics, Inc. (collectively “Mycogen”), are pursuing a patent infringement claim against Monsanto Co. in federal court in California, and it believes *624that Ecogen has information relevant to that claim.
