AMENDED ORDER DENYING DEFENDANT’S MOTION TO DISMISS
MOLLWAY, District Judge.
I. INTRODUCTION.
The Secretary of Labor (the “Secretary”) sued Defendant Local 1357, Interna tional Brotherhood of Electrical Workers, AFL-CIO (“Local 1357”), under Title IV of the Labor Management Reporting and Disclosure Act of 1959 (Act of September 14, 1959, 73 Stat. 519 et seq., 29 U.S.C. §§ 481 et seq., hereinafter the “LMRDA”). Local 1357 moves to dismiss the complaint on the grounds of failure to exhaust internal remedies, mootness, and res judicata. This court DENIES Defendant’s motion to dismiss.
