Action to foreclose a mortgage. There were findings for the plaintiff. The defendants appeal from the order denying their motion for a new trial.

In 1916 the defendant Albert Woolery, a brother of the defendant Boy Woolery, was the owner of 240 acres of land in Faribault county. A quarter section of it was subject to an annuity of *195$275 payable to Ms mother. Albert was unsuccessful in his farming operations, his farm was mortgaged, he had a considerable floating indebtedness and he was discouraged and sick.
