Plaintiffs appealed from an order denying their motion for a new trial.

Neis P. Westberg, herein mentioned as plaintiff, owned a vacant lot in the city of Fergus Falls. Martin Wilson, herein mentioned as defendant, was a carpenter, builder, and contractor. Plaintiff and defendant made a written agreement wherein it was agreed that defendant was to do all carpenter work and furnish all lumber and millwork in constructing a dwelling on plaintiff’s lot for $3,550'.
