OPINION
BREWSTER, Justice.
This case originated in the District Court of Young County, Texas, when John T. Gilmer filed a petition there against Marjorie Harris and Dorothy Gruby alleging that the County Court of Young County had admitted to probate the last will and first codicil of Mattie Kay, deceased, and had ordered that letters testamentary be granted to the plaintiff and to the two defendants as independent co-executors upon their taking the proper form of oath.
