Before proceeding to a discussion of the questions relating to the merits of the controversy between the parties to the original bill, it is necessary to consider whether the demurrer filed by Warfield, Harris and the American Lime and Stone Company should have been sustained. This question has been discussed at length in the case of Schaeffer v. Herman and others, 237 Pa. 86, in an opinion this day handed down.
