WEBSTER, Circuit Judge.

Thomas Gavie was convicted of possession of marijuana with intent to distribute, in violation of 21 U.S.C. § 841(a)(1). Numerous issues are presented on this appeal. Gavie contends that he was denied his constitutional right to a speedy trial, that the contraband found in his home and his automobile should have been suppressed, and that he was denied a fair trial because the trial judge 1 improperly commented upon the evidence and erroneously instructed the jury.
