MEMORANDUM OPINION

COOPER, District Judge.

There are two motions before the Court in this matter: (1) defendant Huntleigh Healthcare’s (“Huntleigh”) motion for summary-judgment pursuant to Federal Rule of Civil Procedure 56; and (2) plaintiffs, William and Kimberly Pousts’ motion in limine for an Order applying Pennsylvania law on the issue of the calculation of damages. The Court held a Federal Rule of Evidence 104 hearing on defendant’s motion for summary judgment on November 6 and 7, 1997.
