The complaint avers in substance- that in September, 1895, and prior thereto, appellant railroad .extended in an easterly and westerly direction through and across the south part of section ten, township thirty-four .north, of range three west, in La Porte county, Indiana; that at said date plaintiff'was the owner and in possession of forty acres of land north of said tract; that appellant negligently permitted dry grass, weeds, and other combustible material to accumulate on its right of way, to the north of said railroad track, at a point in the southeast quarter of said…
