Defendants appeal by leave an order of the Genesee County circuit court, granting an order of superintending control to plaintiff, and directing the racing commissioner to grant a racetrack license to plaintiff as requested.

Plaintiff is a corporation organized and incorporated in recent years for the sole purpose of constructing and operating a racetrack in Richfield Township, Genesee County. On October 28, 1969, plaintiff filed with the Michigan Racing Commission a written application for a license to construct a horse racetrack in Richfield Township.
