FLETCHER, Judge:

Appellant was charged with the premeditated murder of his wife “by shooting her with a shotgun in the back,” in violation of Article 118, Uniform Code of Military Justice, 10 U.S.C. § 918. He pleaded not guilty to this charge and a trial on the merits ensued. The members of his general court-martial found him guilty of murder without premeditation by shooting his wife with a shotgun in the back, in violation of Article 118. In May of 1980 he was sentenced to a bad-conduct discharge, 10 years’ confinement at hard labor, and reduction to the lowest enlisted grade. The…
