Memorandum Decision

ROTH, Judge:

1 Teresa Ockey sued Club Jam and Jam in the Marmalade, LLC (the Club) for personal injuries she sustained after a ladder she was using inside the Club collapsed unexpectedly. The district court granted the Club's motion for summary judgment, and Ockey appealed. Ockey asserts that the ladder the Club produced for her expert to inspect was not the ladder she used the day of her injury.
