PONDER, Justice.
This is an appeal from a judgment sustaining a plea of prescription of ten years acquirendi causa.
Robert Wood Clayton died intestate on May 14, 1910. At the time of his death he was a resident of Concordia Parish. On May 18, 1910, his succession was opened in that parish by petition filed by his brother, John E. Clayton, who applied to be appointed administrator. It is represented in the petition that Robert Wood Clayton was a widower and that his sole issue was his minor son, Robert Waddell Clayton.
