This is a suit in equity, brought in 1890, hy the plaintiffs and appellants, Dennis and Bradley, alleging themselves to be the owners of certain property, to restrain by injunction the Northern Pacific Railroad Company from grading and improving said property. In 1896 the Horthern Pacific Railway Company was substituted as a party defendant for the northern Pacific Railroad Company, the railway company having succeeded to all the rights and liabilities of the railroad company.
