It is alleged and admitted in the pleadings in this case that the plaintiff being the owner of a building in Mystic, on October 5th, 1934, entered into an agreement with the defendant “that if the defendant remains on said premises subsequent to October 31, 1934, he shall remain as a monthly tenant at the rate of two hundred ($200.) dollars a month payable in advance on the first day of each and every month beginning with November 1, 1934.” It is undisputed that the defendant did “remain” on the premises and that certain machinery owned by him was still in the building when this action was…
