Appeal from a judgment of the Supreme Court at Special Term (Viscardi, J.), entered May 17, 1985 in Clinton County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the State Board of Parole revoking petitioner’s parole.
Petitioner was convicted in 1980 of possession of stolen property in the first degree and sentenced to a term of up to five years’ imprisonment. He was paroled in November 1982 and, on February 20, 1983, was arrested for participating in the death of a four-month-old child. Petitioner was then…
