Appeal from a judgment of the Supreme Court (Feldstein, J.), entered January 5, 2006 in St. Lawrence County, which dismissed petitioner’s application, in a proceeding pursuant to CELR article 70, without a hearing.

Following his conviction of manslaughter in the first degree, petitioner was sentenced to a prison term of 1272 to 25 years. Released to parole supervision in 2002, in 2004 he was arrested and charged with rape and sodomy.
