MEMORANDUM AND ORDER

GLASSER, District Judge.

This case arises out of the filming of a video starring music artist Albert Johnson, also known as Prodigy (“Johnson” or “Prodigy”). The video was filmed at Broadway Stages in Queensbridge, New York (the “Site”). Plaintiff Isik Jewelry (“plaintiff’) is a sole proprietorship operated by Beth Isik which manufactures, sells and rents jewelry. Plaintiff rented several pieces of jewelry to Johnson which he wore in the video.
