OPINION

FUTEY, Judge.

This patent case is before the court on defendant’s motions for dismissal and for summary judgment. Plaintiff seeks compensation under 28 U.S.C. § 1498(a) (1988) for the government’s alleged unauthorized use of his patented invention. Defendant contends that plaintiff is not the equitable owner of the patent at issue and, therefore, this court lacks jurisdiction over plaintiff’s claim.
