OPINION AND ORDER

SMITH, Senior Judge.

After an unfavorable judgment in the United States District Court for the Western District of Washington, Myron C. Simmons brings this pro se complaint alleging negligence on the part of the Bureau of Indian Affairs (“BIA”) in managing his trust property, violations of 42 U.S.C. § 1983, and various tort claims. The Government has filed a motion to dismiss under Rule of the Court of Federal Claims (“RCFC”) 12(b)(1) or, in the alternative, for summary judgment under RCFC 56.
