This is a suit brought by Harry V. Bailey, as administrator of the estate of Alexander McCoy, deceased, against Archie L. and Lida Eobison to recover the amount claimed to be due upon two promissory notes, each for the sum of $1000, bearing date June 29, 1898, payable one year after date. The defendants admitted their liability on the notes to the extent of $638.90, which amount was tendered to plaintiff, the tender refused and the money paid into court.
