In April, 1902, appellant, City of Moline, contracted in writing with the Barber Asphalt Paving Company to pave a certain street in accordance with its city ordinance and specifications. The asphalt company furnished a bond in the penal sum of $40,000 with the National Surety Company as surety, for the faithful performance of the contract.
