*1101FEINBERG, Circuit Judge:

Albert Puco was convicted in April 1972 by a jury in the United States District Court for the Southern District of New York, Arnold Bauman, J., of selling narcotic drugs to an undercover federal agent in violation of 26 U.S.C. §§ 4705(a) and 7237(b).1 Puco was sentenced on May 22, as a second time narcotics law violator, to 14 years in prison. This was Puco's third trial on two counts of conspiracy to sell narcotic drugs and sale of such drugs.
