ADELE HEDGES, Chief Justice.
Appellant, Michael Jamil Tyler, appeals from his conviction for the capital murder of Vlryn Veal. A jury found appellant guilty, and the trial court assessed punishment at life in prison. On appeal, appellant contends that (1) the evidence is legally insufficient to support the verdict because the only evidence of an element of the crime was in the form of testimonial hearsay admitted in violation of the Sixth Amendment right of confrontation, and (2) the trial court erred in ruling that the hearsay statement was admissible as an excited utterance.
