— This was an action by the appellees who were taxpayers of Union township, in- White comty, Indiana, against the appellant, who was the tmsurér of that county, to perpetually enjoin the col action of a tax levied in that township, to aid in the eo.istruetion of the Indianap his, Delphi and Chicago Rilroad •through the township.

Demurrer to the complaint for want of sufficient facts overruled. Answer of one paragraph, to whicl a demurrer for want of sufficient facts was sustained, ,nd exceptions taken. Final judgment for the plaintiffsenjoining the collection of the tax.
