LURTON, Circuit Judge.
John S. Shugart, a fireman in the-service of the defendant railway company, was killed by a derailment of the engine upon which he was firing. This is an action-under the Tennessee statute, by his widow, to recover damages.
At the conclusion of all of the evidence, the jury was directed to find for the railway company. There was no dispute but that the deceased was killed by the derailment of his engine. Neither is it claimed that the fact of the derailment and death of the decedent establishes any presumption of negligence, as it might if he had been a passenger. The…
