I. Background

Between 2008 and 2014, Stephen Manley, an African-American male, repeatedly applied for admission from the Thurgood Marshall School of Law at Texas Southern University, historically black institutions. Each of Manley’s applications was denied. Manley, proceeding pro se and in forma pauperis, sued the law school, its admissions committee and dean of admissions, and Texas Southern University.
