Appeal by the defendant, The Santa Clara Lumber Company, from an order of the Supreme Court, made at the St. Lawrence Special Term and entered in the office of the clerk of the county of Franklin on the 19th day of July, 1900, granting the plaintiff’s motion for an in j unction pendente lite restraining the said defendant from selling certain lands and the pulp timber and pulp wood thereon.

Kellogg, J.:

The plaintiff seeks a specific performance by defendant of a contract and asks for a decree directing a specific performance, “and in case of the refusal or neglect of The Santa Clara'Lumber Company to cut, skid and draw the same (pulp wood) for such delivery *226as by said contract provided, then that the cutting, skidding and drawing thereof be done at the expense of The Santa Clara Lumber Company under the covenants of the said contract, as decreed by the court.” The plaintiff also asks for a permanent injunction against the Santa Clara Lumber Company restraining it “ from selling…
