VINING, District Judge.

This matter is before the court on the defendant’s motion for summary judgment. The plaintiff brought suit to recover death benefits under an individual insurance policy issued by the defendant, Transamerica Occidental Life Insurance Company (“Transamerica”), on the life of her husband, Charles E. Cosby. 1 The life insurance policy provided coverage of $350,000 when originally issued in 1987, and was increased to $500,000 in 1989.
