Suit was filed by appellee, First National Bank of Huntsville, against appellant, L. Neal Patterson, in the Circuit Court of Madison County. Appellee sued as transferee of an installment note made by appellant on September 21, 1967. After service of summons and complaint, appellant appeared specially and moved to quash the summons and complaint on the ground that the name of plaintiff on the complaint was First National Bank, not First National Bank of Huntsville as appeared on the summons.
