On March 31, 2006, this court issued an order granting petitioner James P. Dolis’s implicit request for a certificate of appeala-bility from the district court’s dismissal without prejudice of his petition for habeas corpus relief under 28. U.S.C. § 2254. That order also vacated the district court’s decision and remanded with instructions to consider a stay of the federal court proceedings following Newell v.
