OPINION

By FESS, J.:

This is an appeal on questions of law by plaintiff, from a judgment entered by the common pleas court on behalf of defendants.

On May 26, 1931, The Beidler-Curry Coal Company, a corporation, acting through its president and treasurer, made, executed and delivered to the plaintiff, its promissory note in the amount of $2,800.00, payable ninety days after date. Said note bore the endorsement of E. W. Beidler, B. C. Tucker, H. T. Beidler and T. F.
