ZILLY, District Judge.

THIS MATTER comes before the Court on plaintiffs’ motion for partial summary judgment and defendant’s cross-motion for summary judgment. Having considered all materials filed in support of and in opposition to these motions, the Court GRANTS plaintiffs’ motion for partial summary judgment (docket no. 30).
