WERNICK, Justice.

In a trial, jury-waived, in the Superior Court (Kennebec County) defendant was found guilty of the offense (in violation of 17 M.R.S.A. § 2103) of breaking and entering a building in which valuable things were kept and committing larceny therein, the building being identified as the “Rome Elementary School, . . . property of the Town of Rome.” Defendant was sentenced to imprisonment in the county jail at Augusta for eleven months, execution of all but three months of the term being suspended and defendant being placed on probation for two years.
