ERROR TO THE CIRCUIT COURT OS' APPEALS FOR THE SECOND CIRCUIT. In this case there had been no delivery of the cotton by the railway company prior to its destruction by fire. The cotton had arrived at the pier of .the railway company but no notification of its arrival had been given to the steamship company, nor was it in fact in the possession of nor had it been delivered to the latter company. It was still under the absolute control and in the possession of the railway company, and nothing had been done to terminate its common law liability at the time the fire occurred.
