hThe issues in this case arise from a boundary dispute involving a parcel of land located on the east side of Lake Dian in Lincoln County. David Glenn Eifling, representing the Lucille B. Eifling Trust (hereinafter “Eifling”) argues on appeal that the boundary of the property should have been determined by the “top bank” of Lake Dian. Southbend, Inc. (“Southbend”) responds that the circuit court correctly found that the boundary of Lake Dian is determined by the “ordinary high water mark” (“OHWM”).
