The Montana Power Company, respondent, initiated this action in the District Court, Hill County, for a declaratory judgment to determine the “market price” under which it is required to pay royalties to Gay Kravik, appellant, pursuant to an oil and gas lease. The case was submitted to District Court on the pleadings, answers to interrogatories, and a stipulated set of facts. The case was argued orally and deemed submitted March 3, 1977.
