On July 17, 1940, plaintiff, Elmendorf-Anthony Company, a corporation, commenced an action against L. E. Dunn and wife, Long Lake Lumber Company, et al., in the superior court for Spokane county, to foreclose a real estate mortgage. Defendant Long Lake Lumber Company appeared in the action and filed an answer and cross-complaint to plaintiff’s complaint. In its cross-complaint, Long Lake Lumber Company alleged that it held a note secured by a real estate mortgage on the same property covered by plaintiff’s mortgage, and prayed that it have judgment against Dunn and wife on its note and…
