ORDER AND OPINION

HODGES, Judge.

Universal Fidelity has applied for attorney’s fees and costs under the Equal Access to Justice Act sustained in connection with its bid protest against the United States. Prior to our issuing an opinion in the underlying litigation, the Government notified the court of its intention to cancel the challenged solicitation. We dismissed the Complaint without prejudice to plaintiffs right to file a related lawsuit if the new solicitation had the same or similar concerns that prompted the original protest.
