Appeal from District Court, Hays Comity; M. C. Jeffrey, Judge. Action by Ed. W. Giesen against J. M. West and others to establish an easement in an irrigating plant. Judgment for the plaintiff against the named defendant, and that defendant appeals.

It is conceded that the nature and result of this suit are correctly stated in appellant’s brief, as follows:

“Ed. W. Giesen prosecuted this suit in the district court of Hays county, Tex., against ll. M. West, R. L. Eidson, and D. J. Woodward, [illeging that on February 3, 1911, R. L. Eid-fcon and J. C. Wood were the owners of certain leal property situated in Hays county, Tex., a liart of the J. M. Veramendi league No. 2, and leing a tract of 250 acres of land which front-id on the east bank of the San Marcos river Ibout one mile east of the city of San Marcos, ■hat said Wood and Eidson also…
