Appellant brought this action to determine the adverse claims of respondents to certain real estate located in Stearns county, and appealed from an order denying his motion for a new trial.

Patent was originally issued to Levi Hower, who conveyed by warranty deed to Jonathan Woll. In proceedings to enforce the-lien for delinquent taxes for 1885, W. B. Mitchell became the owner of the tax title and quitclaimed the real estate to Henry Beumer, by whose last will and testament it was devised and bequeathed to. his- wife, Mary Beumer.
